Driver Terms of Service
These Driver Terms of Service (“Driver Terms”) govern your participation as a driver partner with Nobleon Rider™ (“we,” “us,” or “our”). By registering as a driver, accepting ride requests, or otherwise using our platform, you agree to these Driver Terms. These Driver Terms are in addition to, and incorporate by reference, our general Terms of Service.
1) Independent Contractor Status
- You are an independent contractor, not an employee, agent, or partner of Nobleon Rider™.
- You set your own schedule and decide whether to accept or decline ride requests.
- You are solely responsible for your actions and omissions while providing services.
- Nothing in these Terms creates an employment, partnership, or agency relationship between you and Nobleon Rider™.
2) Driver Responsibilities & Liability
- You bear full and exclusive responsibility for the safe, lawful, and professional performance of all rides from the moment you accept a request until the passenger is dropped off.
- You are solely liable for any accidents, property damage, personal injury, traffic violations, fines, criminal charges, or civil claims arising from your services.
- You agree that Nobleon Rider™ shall have no liability for any damages, claims, or losses related to your driving, passengers, or vehicles.
- You expressly waive any right to bring claims against Nobleon Rider™ for workers’ compensation, employment benefits, lost income, emotional distress, or any other damages arising from your driving activity.
3) Licensing, Registration & Insurance
- You must hold and maintain a valid chauffeur’s license (for-hire license) or equivalent license required by applicable law.
- You must carry valid vehicle registration and comply with all local, state, and federal requirements.
- You must maintain, at your own cost, commercial/TNC-approved auto insurance covering liability, collision, and comprehensive risks. Personal auto insurance is typically not sufficient.
- Nobleon Rider™ does not provide automobile, health, liability, workers’ compensation, or unemployment insurance for drivers.
4) Background Checks & Compliance
- You consent to background checks, motor vehicle record checks, and ongoing re-verifications as permitted by law.
- You must comply with all applicable Transportation Network Company (TNC) regulations, traffic laws, and safety rules.
- You agree not to discriminate against passengers and to accommodate service animals as required by law.
5) Zero-Tolerance Policy
- No intoxicants: zero tolerance for alcohol or illegal drugs while providing services.
- No unsafe device use: no texting, browsing, or video while driving. Only hands-free calling and pre-set GPS are permitted.
- Violation of this policy may result in immediate deactivation and permanent removal from the platform.
6) Payments, Platform Fees & Payout Schedule
- You receive the fare minus the Nobleon platform fee, displayed in advance before you accept a trip.
- Payouts are disbursed on a weekly basis through our third-party payment processor.
- You authorize Nobleon Rider™ and its payment partners to deduct platform fees, dispute fees, and applicable adjustments before remittance.
- You are solely responsible for reporting and paying all applicable taxes on your earnings.
7) Prohibited Conduct
- No cash payments, no street hails, and no use of unauthorized payment methods.
- No abusive, threatening, or unsafe behavior toward passengers or others.
- No fraudulent bookings, misrepresentation, or tampering with the platform.
8) Confidentiality & Passenger Data
- You must keep all passenger information (names, addresses, phone numbers, routes) confidential and use it only to complete assigned rides.
- You may not contact passengers outside of accepted rides or use their data for any personal or commercial purpose.
9) Telematics, GPS & Safety Monitoring
- By using the platform, you consent to GPS tracking and collection of telematics data (speed, acceleration, braking, cornering) during trips.
- This data may be used for safety reviews, compliance, deactivation decisions, and dispute resolution.
10) Termination & Deactivation
- Nobleon Rider™ may suspend or permanently deactivate your account at its sole discretion for violations of these Driver Terms, unsafe conduct, repeated cancellations/no-shows, loss of license/insurance, or criminal charges/convictions.
- You may stop driving at any time by ceasing to accept ride requests. Outstanding obligations (e.g., unpaid fees) survive termination.
11) Legal Protections & Indemnification
- You agree to indemnify, defend, and hold harmless Nobleon Rider™, its officers, affiliates, and partners against all claims, damages, liabilities, and expenses arising from your services.
- You waive the right to sue Nobleon Rider™ for employment-related claims, benefits, lost wages, injuries, or accidents.
- Limitation of Liability: Nobleon Rider™’s maximum liability under these Driver Terms shall not exceed the platform fees retained from your rides in the three (3) months preceding the claim.
12) Governing Law, Arbitration & Class-Action Waiver
- These Driver Terms are governed by the laws of the State of Florida.
- Any dispute shall be resolved by binding arbitration in Palm Beach County, Florida, under the rules of the American Arbitration Association.
- You and Nobleon Rider™ waive the right to participate in class actions or collective actions.
13) Force Majeure
- Nobleon Rider™ is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, outages, or acts of government.
14) Entire Agreement
These Driver Terms constitute the entire agreement between you and Nobleon Rider™ with respect to your role as a driver partner. They supersede all prior or contemporaneous agreements, oral or written.
